These Terms & Conditions ("Terms") govern your access to and use of the website at fairwayfinders.com.au and any related services (the "Service"), operated by Fairway Finders ("we", "us" or "our").
By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. About the Service
Fairway Finders is an information directory for golf courses in Australia. We provide details such as course locations, maps, green fees, course types, ratings, reviews and articles to help you discover and plan where to play. The Service is an information and discovery tool only.
2. Accuracy of information
We compile course information from a range of sources, including third parties such as Google and course operators. While we try to keep information useful and current:
- course details — including green fees, par, number of holes, opening hours, access and contact details — may be incomplete, out of date or inaccurate; and
- you should confirm details directly with the relevant course before relying on them, particularly fees and tee-time availability.
The Service and its content are provided on an "as is" and "as available" basis, to the extent permitted by law (and subject to section 8).
3. Third-party courses, links and bookings
The Service may contain links to, or direct you to, third-party websites and services, including golf courses, booking providers and Google services. We do not control these third parties and are not responsible for their content, products, services, availability or privacy practices.
Any dealing, booking or transaction you enter into with a course or other third party is solely between you and that third party. Fairway Finders is not a party to, and is not responsible for, any such booking or transaction.
4. Your content (ratings, reviews and submissions)
If you submit ratings, reviews, comments, photos or other content ("User Content"), the following applies:
- Your responsibility. You are solely responsible for your User Content. You must own it or have all rights needed to submit it.
- Accuracy and conduct. User Content must be honest, based on genuine experience, and must not be false, misleading, defamatory, abusive, obscene, unlawful, or infringing of anyone's rights. Do not post fake, incentivised or competitor-sabotaging reviews.
- Licence to us. By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide, perpetual and transferable licence to use, host, store, reproduce, adapt, publish and display that content in connection with the Service.
- Moderation. We may (but are not obliged to) review, moderate, edit, refuse or remove any User Content at any time, with or without notice, including content we consider breaches these Terms.
5. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in breach of these Terms;
- copy, scrape, harvest, "data mine", or systematically extract data or content from the Service, or use automated means (bots, crawlers, scrapers) to access it, without our prior written permission;
- reproduce, republish or commercially exploit our content except as expressly permitted;
- interfere with, disrupt, or attempt to gain unauthorised access to the Service or its systems; or
- introduce malware or any harmful code.
6. Intellectual property
The Service, including its design, layout, text, articles, graphics, branding, the "Fairway Finders" name and logo, and the compilation and arrangement of content, is owned by or licensed to us and is protected by intellectual property laws. Some underlying course data, map data and images are owned by third parties (including Google) and remain their property.
You may view and use the Service for your own personal, non-commercial use. You must not otherwise copy, reproduce, distribute or create derivative works from our content without our permission or the permission of the relevant rights holder.
7. Course owners, advertisers and business users
Additional or separate terms may apply to course owners, advertisers and other business users of the Service. Where they do, those terms apply in addition to these Terms.
8. Consumer guarantees and liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot lawfully be excluded ("Non-excludable Rights").
To the maximum extent permitted by law, and subject to your Non-excludable Rights:
- we exclude all warranties, representations and guarantees not expressly set out in these Terms;
- we are not liable for any loss or damage (including indirect, special or consequential loss, loss of profits, or loss arising from your reliance on information on the Service, from third-party dealings, or from any unavailability of the Service); and
- where our liability cannot be excluded but can be limited, our liability is limited (at our option) to re-supplying the relevant services or paying the cost of having them re-supplied.
9. Indemnity
To the extent permitted by law, you agree to indemnify us against any reasonable loss, cost, liability or expense we suffer arising from your breach of these Terms, your misuse of the Service, or your User Content infringing the rights of any third party.
10. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
11. Changes to the Service and these Terms
We may change, suspend or discontinue any part of the Service at any time. We may also update these Terms from time to time; the current version will be posted on this page with the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
12. Suspension and termination
We may suspend or terminate your access to the Service (or any part of it) at any time if you breach these Terms or if we reasonably consider it necessary to protect the Service or other users.
13. Governing law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State.
14. General
If any part of these Terms is found to be invalid or unenforceable, that part is severed and the rest continues to apply. Our failure to enforce a provision is not a waiver of it. These Terms are the entire agreement between you and us about your use of the Service.
